I understand that DivorceOptions.ca is a document preparation service intended to assist married couples in the preparation and filing of uncontested divorce applications in British Columbia, Canada on the grounds of separation of at least one year.

I understand that DivorceOptions.ca is published by a lawyer but it is not a law firm or a lawyer and does not provide legal advice.

I agree that DivorceOptions.ca has not provided legal advice, or opinions or recommendations about my legal rights.

I understand that the information provided by DivorceOptions.ca is intended to provide general information regarding the divorce process in British Columbia, Canada. It is not a statement of the law or legal advice.

I understand that DivorceOptions.ca does not guarantee the legal accuracy of the information it provides and does not accept responsibility for any loss or inconvenience suffered by users as a result of any inadvertent inaccuracies or otherwise.

I understand that I should seek legal advice if there is something in the information or the services provided by DivorceOptions.ca that I do not understand.

I understand that DivorceOptions.ca exists solely within the province of British Columbia, Canada. I agree that regardless of where I reside or where my browser is physically located, my viewing and use of DivorceOptions.ca occurs solely within the city of Vancouver in the province of British Columbia, Canada and that all content and services shall be deemed to be served from, and performed wholly within, Vancouver, British Columbia, Canada as if I had physically traveled there to obtain the service. I agree that British Columbia law shall govern any disputes arising from my use of this website, and that the courts of the city of Vancouver, province of British Columbia, shall have exclusive jurisdiction over any disputes.

2. Privacy Policy

DivorceOptions.ca respects your privacy and permits you to control the treatment of your personal information. A complete statement of DivorceOptions.ca's current Privacy Policy can be found on our web site. DivorceOptions.ca's Privacy Policy is expressly incorporated into this Agreement by reference.

3. British Columbia Divorce Service

I agree that DivorceOptions.ca has made no warranties or guarantees or expressed an opinion about the outcome of my divorce application.

I understand that the divorce papers provided by DivorceOptions.ca will be prepared in accordance with the requirements of the Supreme Court of British Columbia, Canada.

I understand that my divorce papers will be created by DivorceOptions.ca's software solely in accordance with my answers to the online questionnaire(s) subject to DivorceOptions.ca's Accuracy Review.

I understand that, unless otherwise agreed, the divorce papers provided by DivorceOptions.ca will only make a claim of divorce and no other claims will be made for access, custody, child support, guardianship, spousal support or division of property.

I understand that, unless otherwise agreed, I am responsible for filing my divorce papers in court, paying the applicable court fees, notary fees and process server fees as may be necessary in order to finalize my divorce application.

I understand that DivorceOptions.ca's British Columbia Divorce Service includes the following features and benefits as set out below and that no other warranties or guarantees have been made:

  • Accuracy Review (as defined below 'Accuracy Review')
  • Unlimited Customer Support (as defined below 'Customer Support')
  • 60 days Free Updates (as defined below 'Updates')
  • 100% Money-Back Guarantee (as defined below 'Money-Back Guarantee')

4. Accuracy Review

I understand that DivorceOptions.ca's review of my answers is limited to completeness, spelling, and grammar as well as internal consistency of names, addresses and similar information.

I understand that DivorceOptions.ca's review of my answers does not include legal advice or opinions or recommendations about my legal rights, legal obligations or the substance of my answers.

I agree to read the final paper(s) before signing them and agree to be solely responsible for the final paper(s). I will hold DivorceOptions.ca and its agents harmless. If there is liability found on the part of DivorceOptions.ca, it will be limited to the amount paid for services, and under no circumstances will there be special damages.

5. Customer Support

I understand that the customer support provided by DivorceOptions.ca is intended to provide general information regarding the divorce process in British Columbia, Canada. It is not a statement of the law or legal advice.

I understand that the customer support provided by DivorceOptions.ca is intended to be provided by email, which is inherently more efficient and less expensive than telephone support.

I understand that DivorceOptions.ca will try to answer any question that I may have regarding the British Columbia divorce process, their services, or my order by email and if, at the discretion of DivorceOptions.ca, it is determined that customer support by telephone is preferable, DivorceOptions.ca will telephone me.

6. Money-Back Guarantee

I understand that the 100% Money-Back Guarantee provided by DivorceOptions.ca is limited to instances where the divorce papers provided by DivorceOptions.ca are not accepted by the court due to the fault of DivorceOptions.ca.

I understand and agree that if my divorce papers are not accepted by the court I may be asked to provide DivorceOptions.ca with the reasons for rejection provided to me by the court so that DivorceOptions.ca can correct the problem.

I understand that DivorceOptions.ca will make any changes to my divorce papers requested by the court or judge, as often as necessary, without charge, or, at the discretion of DivorceOptions.ca, a refund will be issued for the full purchase price.

I understand that DivorceOptions.ca cannot guarantee the results or outcome of my divorce. For example, DivorceOptions.ca cannot guarantee that the judge will grant my divorce, or that the information I provide is acceptable, or that my divorce will not become contested. Accordingly, any situation or event that is beyond the control of DivorceOptions.ca is not covered by this 100% Money-Back Guarantee.

7. Refunds

I understand that upon my request DivorceOptions.ca will provide a full refund for any service that DivorceOptions.ca has not yet started subject to the conditions set out below:

  • I agree that fees for services are not refundable after DivorceOptions.ca has contracted with or paid those fees to a third party, such as a process server, a translator, Vital Statistics, or the court.
  • I agree that DivorceOptions.ca is under no obligation to provide a refund for document preparation after they start processing my order.
  • I agree that DivorceOptions.ca is under no obligation to provide a refund for court filing services after I submit my divorce papers to DivorceOptions.ca for filing with the court.
  • I agree that to request a refund I must reply to my order tracking email within 30 days of purchase.

8. Updates

I understand that the document preparation service provided by DivorceOptions.ca includes unlimited free updates of my divorce papers for 1 year from the date of purchase.

I understand that further updates of my divorce papers can be obtained between year one and year two by purchasing additional updates from DivorceOptions.ca.

I understand that DivorceOptions.ca is under no obligation to update my divorce papers if the update period has expired or two years have passed since the date of purchase.

I understand that all services purchased from DivorceOptions.ca expire two years after the date of purchase.

9. Shipping

I understand that DivorceOptions.ca will notify me of my order status by email and that it is my responsibility to ensure that I can receive email from DivorceOptions.ca.

I understand that my order will be shipped by email as an attachment in a compressed (zipped) folder in portable document format (PDF) and that it is my responsibility to ensure that I have the appropriate software such as the free Adobe Reader and a printer in order to view and print my divorce papers.

I understand that it is my responsibility to ensure that I have provided a valid email address to DivorceOptions.ca.

10. Children of the Marriage

I understand that the court must be satisfied that reasonable arrangements have been made for the support of any children of the marriage, having regard to the child support guidelines, before a divorce will be granted.

I understand that DivorceOptions.ca will not review or consider my child support arrangements in any manner whatsoever when processing or filing my divorce papers.

I agree that it is my sole responsibility to make sure that my child support arrangements have been made with regard to the child support guidelines.

11. Property Division

I understand that there are limitation periods for claiming property division which are affected by the divorce.

I understand that if property division is unresolved at the time of my divorce it may be legally impossible to pursue these rights at a later date.

12. Spousal Support

I understand that there are limitation periods for claiming spousal support which are affected by the divorce.

I understand that if spousal support is unresolved at the time of my divorce it may be legally impossible to pursue these rights at a later date.

13. Court Filing Service

I understand that the court filing service provided by DivorceOptions.ca is limited to filing my divorce papers in court, providing status updates by email as and when required, and managing my divorce through the court system.

I agree that it is my responsibility to provide DivorceOptions.ca with documents in a manner that is acceptable to the court.

I understand that, unless otherwise agreed, the court filing service provided by DivorceOptions.ca is limited to filing uncontested divorce papers and associated documents purchased from DivorceOptions.ca.

I understand that, unless otherwise agreed, DivorceOptions.ca will file my divorce papers at the New Westminster Registry of the Supreme Court of British Columbia, Canada.

I agree that DivorceOptions.ca is under no obligation to file my divorce papers for any particular stage additional times if the papers are not accepted by the court due to any situation or event beyond the control of DivorceOptions.ca.

I authorize DivorceOptions.ca its agents, employees and representatives to revise my divorce papers in order that the information on those papers is consistent with the Certificate of Marriage as provided to DivorceOptions.ca. I understand that this may include correcting the names, date of birth, place of marriage, or date of marriage on the divorce papers. I also understand that any correction(s) are done solely for the purpose of acceptance of my papers by the court and that no legal advice, or opinions or recommendations about this information has been sought or is given.

I understand that the court filing service does not include the court filing fees that are charged by the court.

I understand that I am responsible for paying the court filing fee as and when each filing is made.

I understand that DivorceOptions.ca is not responsible for any difference in the court filing fee it collects, or advises me of, and the actual court filing fee should there be one.

14. Online Legal Assistance Service

I understand that the online legal assistance service available on this web site is provided by Maria Cook who is a lawyer licensed to practice law in the province of British Columbia, Canada.

I understand that if I purchase the legal assistance service I am not a client of the lawyer until all of the following conditions have been met:

  • the lawyer has had an opportunity to review my situation and has determined that it is suitable for the online legal assistance service;
  • the lawyer has had an opportunity to do a conflict check and determines that there is no conflict of interest and;
  • I have signed and returned the retainer agreement to the lawyer.

I understand that if any of the conditions indicated above are not met that a refund will be given for the full purchase amount of the legal assistance service.

I understand that if all of the above conditions are met that I become a client of the lawyer and that there is a lawyer-client relationship created.

I understand that the legal assistance service is intended to assist and advise me regarding completion and filing of my uncontested divorce application having regard to my claim of divorce only.

I understand and agree that I continue to be self represented and that the lawyer is not acting for me in my divorce application or representing me in any way whatsoever or advising me of my legal rights or obligations.

15. Internet Security & Privacy

Absent the use of encryption, the Internet is not a secured medium and privacy cannot be ensured. Internet e-mail is vulnerable to interception and forging. DivorceOptions.ca will not be responsible for any damages you or any third party may suffer as a result of the transmission of confidential information that you make through e-mail or third party links provided on this web site. DivorceOptions.ca is not responsible for any errors or any changes made to any transmitted information. Should you decide to transmit information using e-mail or third party links, you do so at your own risk.

16. Links to Other Sites

This web site may contain links to other sites as well as e-mail links. These links are provided solely as a convenience to you. These other web sites were independently developed by parties other than DivorceOptions.ca and DivorceOptions.ca assumes no responsibility for the accuracy or appropriateness of the information contained in such sites. The inclusion of any link to another web site does not imply endorsement by DivorceOptions.ca.
